Mudiwa was sentenced to seven years in prison by a Mutare magistrate, Hlekani Mwayera in 2007. He appealed at the High Court against both the sentence and conviction. The Attorney – General’s office said it would not contest Hon. Mudiwa’s appeal as the magistrate had erred by failing to exercise caution in her analysis of the evidence given that most of the witnesses called had an interest to serve.
